Take Action To Support S.5678 re: Spousal Maintenance

Dear Family Law Section Member,

I am writing to request your immediate assistance to urge your New York State Senator to support the Maintenance Guidelines bill that our Section has strongly supported. S.5678, sponsored by Senate Judiciary Chairman John Bonacic, would amend the Domestic Relations Law (DRL) and the Family Court Act (FCA) in relation to the duration and amount of maintenance and spousal support, and it would eliminate enhanced earning capacity as an asset while making it a factor to be considered by the court when awarding maintenance. This bill was developed with the support of the Matrimonial Practice Advisory and Rules Committee to the Chief Administrative Judge of the Office of Court Administration. We strongly believe that this bill would enhance our area of the law, and that it represents the best compromise of many competing views on this issue. In addition to the support of our Section, the bill is supported by the Women’s Bar Association of the State of New York, the New York Chapter of the American Academy of Matrimonial Lawyers, and the New York State Maintenance Standards Coalition, all of whom participated in the discussions that resulted in this legislative proposal.
