Prior to a final vote on the Partial-Birth Abortion Ban Act (H.R. 4965), pro-abortion Rep. Tammy Baldwin (D-Wi.) made a motion to amend the bill to permit partial-birth abortion whenever an abortionist asserts the abortion would preserve a woman's "health" (legally, this term includes any claims of benefit to emotional and mental "health"). NRLC opposed this gutting motion/amendment, which failed, 187-241, Roll Call No. 342, July 24, 2002. Those House members who voted for this unsuccessful gutting amendment were not authentic supporters of a ban on partial-birth abortion, even if they supported final passage of the bill on the following roll call.
