By 47 yeas to 51 nays (Vote No. 9), three-fifths of those Senators duly chosen and sworn not having voted in the affirmative, Senate rejected the motion to waive section 904 of the Congressional Budget Act of 1974 and section 4(g)(3) of the Statutory Pay-As-You-Go Act of 2010, and all applicable sections of those Acts and applicable budget resolutions, with respect to McConnell Amendment No. 13, to repeal the job-killing health care law and health care-related provisions in the Health Care and Education Reconciliation Act of 2010. Subsequently, a point of D67order that the amendment was in violation of section 311 of S. Con. Res. 70, the concurrent resolution on the budget for fiscal year 2009 was sustained, and the amendment thus fell.
